Terms & Conditions

These Terms govern your company's use of Track My Staff — our face-recognition attendance platform, admin panel, kiosk scanner, and mobile app. By creating a company account or using the Service, you agree to these Terms.

Effective January 1, 2026 · Operated by Track My Staff

1. Definitions

2. Accounts & eligibility

A Company Admin registers the Company account and is responsible for all activity under it, including accounts they create for HR Admins, Scan Admins, and Employees. You must provide accurate registration details and keep login credentials confidential.

You must have the authority to bind your organization to these Terms, and to enroll your employees in the Service, before doing so.

3. Subscriptions & billing

Access to the Service is subscription-based. Plan features, limits, and pricing are shown in the admin panel at the time of signup or upgrade. A free trial period may be offered at our discretion and does not obligate continued access afterward.

Where payments are submitted for manual review (e.g. bank transfer receipts), access continues at the reviewer's discretion until the payment is approved or rejected. Non-payment or a lapsed subscription may result in restricted or suspended access, subject to Section 9.

Fees are not refundable except where required by applicable law or expressly stated at the time of purchase.

4. Acceptable use

6. Data responsibility

As between you and us, your Company is the data controller for the personal data of your employees processed through the Service (names, contact details, attendance records, and biometric descriptors); we process it as your data processor, under the terms of our Privacy Policy. You are responsible for the accuracy of data you or your Employees submit, and for any notices or consents your organization owes its own employees.

7. Intellectual property

The Service, including its software, design, and branding, is owned by Track My Staff or its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes — no other rights are granted.

8. Service availability & changes

We aim for reliable availability but do not guarantee the Service will be uninterrupted or error-free. We may modify, add, or remove features, and may perform scheduled or emergency maintenance, with reasonable notice where practical.

9. Suspension & termination

We may suspend or terminate access to the Service, in whole or in part, for a Company or an individual account, if: subscription fees remain unpaid; the account is used in violation of Section 4; or we reasonably believe continued access poses a security or legal risk. You may cancel your subscription at any time through the admin panel; cancellation takes effect at the end of the current billing period unless stated otherwise.

10. Limitation of liability

To the fullest extent permitted by law, Track My Staff is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including reliance on attendance records for payroll or disciplinary decisions — you remain responsible for reviewing and correcting attendance data before acting on it.

11. Governing law & disputes

These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Sri Lanka, unless the parties agree in writing to another form of resolution (such as arbitration).

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify Company Admins through the admin panel or by email. Continued use of the Service after a change takes effect means you accept the revised Terms.
